The following is the contractual document that will govern the contracting of products and services through the website https://ritual-incense.com owned by Francisco Pérez Salvador (hereinafter “the Provider” or “Ritual Incense”). Acceptance of this document implies that the User:

1. Has read and understood the conditions stated herein.
2. Is a person with sufficient capacity to contract the products or services.
3. Accepts all the obligations stated herein.

These terms and conditions will have an indefinite period of validity and will be applicable to all contracts made through the Provider’s website https://ritual-incense.com.

PLEASE NOTE: The Provider reserves the right to unilaterally modify these Terms and Conditions, without this affecting the purchases made and/or the promotions launched before said changes. On the other hand, unless otherwise indicated, any contact made by telephone or fax/modem will have the same cost as local calls, so they will not cost more than the basic rate.

PLEASE NOTE: Under Law 12/2003, of 24 November, on the reform of Law 4/1997, of 9 July, on prevention and assistance in drug-related matters, as amended by Law 1/2001, of 3 May, article 1 prohibits the sale or supply to minors under 18 years of age. This restriction does not limit the sale or supply to persons over 16 years of age who are accredited for the professional use of the product. In the second case, they are legally required to provide Ritual Incense with proof of said accreditation.

PLEASE NOTE: In accordance with the current regulations on credit card brands:

“This merchant agrees not to allow any transaction that is illegal, or is deemed by credit card brands or the acquiring bank to have the potential to harm or negatively influence their goodwill. The following activities are prohibited under the card scheme: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards.”

Identity of the Parties

The party of the first part, the Provider of the goods or services contracted by the User is Francisco Pérez Salvador, with registered office at Montseny, 31, Urbanización Mas de Can Pi, 08758, Cervelló (Barcelona, Spain), NIF 46579481L.

And the party of the second part, the User, whether registered or not on the website, is responsible for the veracity of the personal data provided to the Provider.

Purpose of the Contract

The purpose of this contract is to regulate all purchase transactions between the Provider and the User of this website, as of the moment the latter checks the corresponding box.

The purchase transaction entails the delivery of a specific product and/or service in exchange for the payment of a price that shall be published on this website.

Contracting Procedure

Orders can only be placed in Spanish. If, in the future, this process can be conducted in any other language, this shall be indicated before the start of the order.

In order to access the services offered by the Provider, the User must register on the website by creating a user account. In order to do so, the User must freely and voluntarily provide the personal data required.

The User will select a username and password, undertaking to use them diligently and not make them available to third parties, as well as to notify the Provider of the loss or theft of said username and password, or of any possible access by an unauthorised third party, so that the Provider can proceed to block them immediately.

Users shall not choose as their username words, expressions or word combinations that are offensive, insulting, trademarked, trade names, establishment names, company names, advertising slogans, names and pseudonyms of public persons or celebrities that they are not authorised to use and, in general, contrary to the law or to moral standards and generally accepted good practices.

Once the User account has been created, the User is advised that, in pursuance of art. 27 of Law 34/2002 on Information Society and Electronic Commerce Services, the contracting procedure will follow the following steps:

1. Add product to the shopping basket. Indicate the product quantity. The purchase must amount to more than 10 euros.
2. Order method. The User must make the order as a guest or registered user.
3. Billing details. Indicate the shipping address and delivery territory.
4. Payment type (PayPal).
5. Check and place the order. Click on “I have read and accept the Terms and Conditions” to confirm the order.
6. Payment information.

In any case, once the order has been confirmed, the Provider’s contracting platform will provide the User with a summary of the product characteristics, price, mode of transport, date of purchase, and estimated delivery date of the contracted product or service.  Likewise, an email will be sent to the User confirming the order.

Adequate access to the online store depends on the telecommunications system used and in particular on the internet network, so the Provider is not responsible for interruptions, delays or errors in the service due to causes beyond its control, nor for those resulting from the User’s computer equipment and/or network connection.

Order Delivery

Orders will be delivered to the shipping address freely designated by the User. If, at the time of receiving your order, one or more of the products you selected is not available or out of stock, unfortunately it will not be possible to fulfil your order in its entirety. In this case, we reserve the right to choose whether to partially fulfil your order or reject it completely. In any case, we would inform you immediately via email.

If the merchandise you requested is available, the delivery time will be six to ten working days, from the date of reception of your order.

Deliveries are made exclusively in mainland Spain and the Balearic Islands. Our online store is not operational in the rest of the country. Therefore, orders cannot be accepted to deliver to these destinations.

As such, the Provider shall not be held liable for delivery failures resulting from inaccurate, incomplete or untruthful data as entered by the User, nor for orders not delivered due to circumstances beyond the control of the Provider or the shipping company, assigned for this purpose, such as the absence of the recipient.

Notwithstanding the foregoing, the Provider shall take all the measures required to meet delivery times or, if this is not possible, to deliver orders as soon as possible, to the satisfaction of both the sender and the recipient, with the Provider therefore disclaiming all liability in this respect.

Price and Validity Period of the Offer

All the indicated prices of goods on the online store include VAT and any applicable expenses and are expressed in euros (€). Additionally, for each shipment, the User will be charged an amount for shipping costs. This amount may vary depending on the order placed and the location of the shipping address.

The prices applicable to each product will be those published on the website, which will be automatically applied in the last phase of the order process. The Customer assumes that, in any case, the economic valuation of some products may vary in real time. In any case, this will always be communicated to users in advance.

Any payment made to the Provider will entail the issuance of an invoice in the name of the registered User at the end of the purchase process. Said invoice will be sent automatically to the email address provided by the User, as well as included in the delivery package with the purchased product.

Payment Methods

The delivered goods remain the property of Ritual Incense until the full price of the payment has been paid.

Payment is made in advance via PayPal (upon registration, your bank or credit card details are deposited with said company).

We inform you that, under the conditions that you have stipulated with credit institutions or other institutions, you may incur additional expenses for transfer costs, account management, etc. We recommend that you check with your bank or credit card issuer about this. The Provider agrees and provides that, at no time will the User be charged for the use of the aforementioned payment method.

We reserve the right to individually restrict the use of the above payment methods to one or more options.

We use secure payment systems from leading financial institutions in electronic commerce. In this regard, confidential payment details are encrypted (SSL) and transferred directly to the financial institution.

Credit card payments have an order processing time of 48 hours.

Right of Withdrawal

The User has a period of 14 calendar days from the date of receipt of the product to return it. This does not apply to products sold “in bulk or by the metre”, such as fabrics, unless one complete piece is purchased. Return shipping costs will be borne by the User, unless the return is due to product defects. In any case, the product must be returned in its original packaging and in perfect condition. ON THE CONSEQUENCES OF WITHDRAWAL AND REVOCATION. In the event of a valid communication of withdrawal or revocation, the benefits received, and the benefits obtained (e.g. interest) must, where appropriate, be mutually returned.

In the event that the buyer is not able to return the benefits received, in whole or in part, or only in deteriorated condition, the buyer is obligated to compensate Ritual Incense for the corresponding amount. Additionally, in order to prevent the payment of compensation as a consequence of deterioration resulting from the use of a product, we recommend that you do not start using it as if it were your property, and avoiding everything that could reduce its value (i.e. products must not have been used or damaged, must retain their original label, and must be returned in their original packaging.) The returned merchandise should be sent to Francisco Pérez Salvador, with registered office at Montseny, 31, Urbanización Mas de Can Pi, 08758, Cervelló (Barcelona, Spain), with the freight due and at the risk of the recipient. Any obligations for the restitution of payments and benefits will be fulfilled within a maximum period of 30 days. Said period shall commence for the buyer once they send their declaration of revocation or return the merchandise, and for Ritual Incense once they receive said return.

Applicable Warranty

The warranty of the items sold on this website is offered in compliance with the provisions and criteria set forth in Royal Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws.

Data Protection

For the purpose of the regulations on the protection of personal data and the regulations on electronic commerce, the data controller in charge of the online store is Ritual Incense.

We will only use your personal data in the terms provided by Law and based on your consent; especially regarding data related to the reception and fulfilment of your order (e.g. name, address, email, information about things ordered/purchased, data about your behaviour regarding orders and payments, etc.), as well as any other data that you provide us voluntarily.

Applicable Law and Jurisdiction

These terms and conditions shall be governed by or interpreted in accordance with Spanish law in all matters not expressly established. The Provider and the User agree to submit any dispute that may arise from the provision of the products or services covered by these Terms and Conditions, to the Courts and Tribunals of the city of Barcelona.
